I think some of you had it in for me and Kurt as we were doing a shared buy and so on that point all i have to say is

In my role as a Cop I thought I could clear up some of the concerns about buying this incase it's stolen...

In England the crime of theft is one of statute - as opposed to North of the border where it's a crime at common law. As the property is now in England I shall go on English law.

For the offence of theft to be complete there has to be certain elements present. It is important to realise that ALL these elements must be present, if one of them is absent then the crime is not complete and there can be no offence of Theft.

The elements are -

1. There musy be dishonest apropriation
2. There must be property
3. The property must belong to 'another'
4. There must be an intention to permanently deprive.

Working backward, the 'permanent deprivation' is obvious. If you keep it, or even throw it away the owner cannot get it back. So he is deprived of it. Following on from that, to borrow something with the intention to give it back can never be theft.

Property must belong to someone, gets a bit complicated when you're taking stuff from skips - yes it might have been binned but legally the skip owner now owns it. Likewise, you cannot steal wild flowers if you pick them - if they have been planted/cultivated and you pick them that can be theft.

You must steal property, property is defined as something tangible ie you can touch it - that is why you cannot steal electricity. It is not tangible (there is a seperate offence of electricity abstraction to deal with this). Same as broadband, you hack into your neighbours broadband you are not stealing it (albeit this is an ongoing issue waiting for a legal precedent)

And finally, the most important one is the 'dishonest appropriation'. This is the big one where most things fall down. A lot of the time if someone gives you something and they don't give it back... it's not theft as they have not taken possession of it illegally.

So, for the ground anchor, should Ebony be looking after it for someone, saw while they are on holiday or something, but decides to sell it. The buying who subsequently takes possession of it has done nothing wrong. The original owner has no recourse towards the new owner. Their only hope of any sort of restitution would be to chase Ebony through a civil or small claims court.

Hope that puts the lucky buyers mind at rest....
